TAR annuls ICA’s decision and rules in favor of Wind Tre

The Administrative Tribunal of Lazio (TAR) has annulled the decision by the Italian Competition Authority (ICA) whereby telecommunications operators had been found to have breached competition law.The allegation was that operators had coordinated their strategy following the Government’s and regulator’s decision to impose a monthly billing cycle for telecommunications services, and had all agreed to comply with the new requirement by keeping their prices unchanged and refraining from granting discounts which would have spurred customer mobility. Vodafone wins against Eutelia

Vodafone won its appeal against Eutelia in an action for damages. The case concerns an alleged margin squeeze in the market for fixed-to-mobile voice call termination services. The alleged abuse had been investigated by the Italian Competition Authority in 2007 and was closed with a commitment decision. Eutelia, a fixed operator, had sued Vodafone and asked for compensation for the damages allegedly suffered. Continue reading Vodafone wins against Eutelia

Two new judgements on copyright violation by video sharing platforms

On July 17, 2019 the Tribunal of Rome issued two judgements awarding damages to RTI (Mediaset Group) for copyright infringements by Dailymotion S.A. and Vimeo LLC. The Court found that both video sharing platforms infringed RTI’s copyrights by publishing on their portals audiovisual content drawn from RTI’s programs and awarded RTI damages for a total of 10.3 million euros (5.5 for Dailymotion and 4.8 for Vimeo). The first 18 italian companies taking action against the truck cartel

The action for damages has its roots in the European Commission decision that established the existence of a cartel among DAF, Daimler/Mercedes-Benz, Iveco, MAN/Volkswagen, Volvo/Renault and Scania in the market for trucks weighting more than 6 tons from 1997 to 2011, fining it with the highest sanction ever imposed on a cartel for 3.8 billion euros.
