The Italian court of Milan has rebutted the damages claim against Enel

In 2018, a telecom operator sued Enel, one of the main operators in the Italian electricity market, for the interruption of a commercial partnership entailing the provision of a bundled offer which included electricity and telecom fixed services. Lear assisted Enel and showed that the claimant’s request for damages lacked a concrete explanation of the causal relationship between the interruption of the partnership and the alleged damages suffered. In November 2020, the Italian Court of Milan has rejected the allegations of the telecom operator against Enel. In line with Lear’s analyses, the judge has established, inter alia, that the damages request was generic and unfounded.
