Alleged foreclosure in the market for maritime freight transport

Lear has assisted Moby in its appeal before the administrative court seeking to overturn the finding of the Italian Competition Authority (ICA) that Moby had abused its dominant position in the market for maritime freight transport to and from Sardinia.
Lear submitted a report to the court, setting out the reasons why Moby’s conduct did not amount to an abuse, but was rather a legitimate and pro-competitive response to increased competition in the market, spurned by entry of a rival. The judgment is currently pending. Lear had already assisted Moby during the ICA investigation.
