ICA’s decision in I811 set aside by Administrative Tribunal

The Administrative Tribunal of Lazio has upheld the appeal lodged by car manufacturers and their captive banks, setting aside the decision of the Italian Competition Authority (ICA) alleging an horizontal agreement between captive banks and regarding the purchase of motor vehicles through financing supplied by captive banks. Two new judgements on copyright violation by video sharing platforms

On July 17, 2019 the Tribunal of Rome issued two judgements awarding damages to RTI (Mediaset Group) for copyright infringements by Dailymotion S.A. and Vimeo LLC. The Court found that both video sharing platforms infringed RTI’s copyrights by publishing on their portals audiovisual content drawn from RTI’s programs and awarded RTI damages for a total of 10.3 million euros (5.5 for Dailymotion and 4.8 for Vimeo). Italian Competition Authority’s decision against Radio Taxi 3570 overturned in Court

The Regional Administrative Tribunal (TAR) upheld the appeal of Radio Taxi 3570 and annulled last year decision of the Italian Competition Authority (ICA) for the alleged foreclosure effects of the non-compete clause which prevents taxi drivers associated with the three largest cab dispatching cooperatives in Rome from accepting calls for service from competitors. Vimeo ordered to pay damages to RTI for copyright infringement

On January 10, 2019 the Tribunal of Rome issued a judgement in a case between RTI (Mediaset Group) and Vimeo LLC. The Court found that Vimeo had infringed RTI’s copyrights by publishing on its portal audiovisual content drawn from RTI’s programs and awarded RTI damages for 8.5 million euros. Read more

ALLEGED HORIZONTAL AGREEMENT IN THE MARKET FOR OPERATING LEASE IN ROMANIA

Lear is assisting the Association of the Operational Leasing Companies (“ASLO”), an association of companies providing operating lease of motor vehicles and related services in Romania, investigated by the Romanian Competition Council for having allegedly enabled an exchange of sensitive and detailed commercial information among its associates. The Italian Competition Authority clears joint bidding by Grifols and Kedrion

On December 12, 2018, the Italian Competition Authority (ICA) found that the agreement between Grifols and Kedrion to submit a joint bid for the contract manufacturing of plasma therapeutic products derived from blood donations was not anticompetitive, but rather enhanced the welfare of the Italian Healthcare System. LEAR’s activity 2018: proceedings before the ICA
